Bill C-3
, Gender Equity in First Nations Registration Act was proclaimed into force on January 31, 2011. This Bill was introduced to respond to the April 6, 2009 British Columbia Court of Appeal ruling in the McIvor case (http://www.courts.gov.bc.ca/jdb-txt/CA/09/01/2009BCCA0153.htm).
Enacting Bill C-3
means that individuals born after 1951 who were previously ineligible for registration under the Indian Act due to their grandmother having lost her status as a result of marriage are now eligible. AFN will continue to advocate for additional resources for First Nation governments and programs to respond to any increase in eligible recipients.
